Terms of Service

These terms are an agreement between you and FanSpark Pty. Ltd. (ACN 664 589 119), trading as Mates Picks. They cover the Mates Picks app, this website and anything connected to them. By creating an account or using Mates Picks, you accept these terms. If you do not accept them, please do not use Mates Picks.

1. Who can use Mates Picks

You must be 18 or over. You need to give an accurate date of birth when you sign up, and we may close accounts that do not meet this requirement. Mates Picks is aimed at people in Australia, and some features depend on Australian competitions.

2. Your account

  • Give us accurate details and keep them up to date.
  • Keep your password to yourself. You are responsible for what happens on your account.
  • One account per person. Do not share or sell an account.
  • Tell us at support@fanspark.com.au if you think someone else has access.

You can delete your account at any time from Profile in the app, or at matespicks.com.au/delete-account.html.

3. There is no betting and no real money

Mates Picks is a social competition, not a gambling service. Points, streak bonuses, bragging rights and anything in a group pot are in-app scorekeeping only. They have no cash value, cannot be exchanged for money or anything of value, cannot be withdrawn, and are not transferable outside the app. There is no entry fee, no wagering, and no prize funded by players.

4. Picks, groups and results

  • Picks close when a game starts. A pick made after that will not be accepted.
  • Results, scores and ladders come from third-party data feeds. They can be delayed or wrong, and we correct them when we can.
  • We may recalculate points if a result changes or a scoring error is found.
  • Do not use bots, scripts or multiple accounts to affect a competition.

5. Chat, banter and your content

You own what you post. You give us permission to store and display it so the app works for you and your group. Do not post anything unlawful, hateful, harassing, sexual, violent, deceptive or infringing, and do not post other people's personal details.

You can report or block another member from the chat or Fans Nearby. We can remove content and suspend or close accounts that break these terms, and we act on reports we receive.

6. Fans Nearby and location

Fans Nearby only works if you allow location access. Other members see an approximate distance band, never your exact position or address. You can switch it off by withdrawing the permission in your phone settings.

7. Purchases and subscriptions

  • Sticker packs are one-off purchases. MatesPicks Pro and Corporate are subscriptions that renew automatically until cancelled.
  • All purchases are processed by Google Play or the Apple App Store, not by us.
  • Cancel a subscription in your store account. Cancelling stops the next renewal and you keep access until the period you paid for ends.
  • Refunds follow the store's policy. Contact us at support@fanspark.com.au and we will help where we can.
  • Prices may change. A change never affects a period you have already paid for.

Nothing here limits your rights under the Australian Consumer Law, including guarantees that cannot be excluded.

8. Leagues, clubs and trademarks

Mates Picks is an independent app. It is not affiliated with, endorsed by or sponsored by the NRL, the AFL, Cricket Australia or any club. Competition, club and player names are used to describe fixtures and results, and remain the property of their owners.

9. Availability and changes

We aim to keep Mates Picks running, but we cannot promise it will always be available or error free. We may add, change or withdraw features, and we may run maintenance that interrupts the service.

10. Suspension and closing accounts

We may suspend or close an account that breaks these terms, harms other members, or is used unlawfully. You can close yours at any time. Some records are kept after closure where the law requires it, as set out in our Privacy Policy.

11. Our liability

To the extent permitted by law, Mates Picks is provided as is, and we are not liable for indirect or consequential loss, or for loss caused by third-party data, app stores or your device. Where liability cannot be excluded, it is limited to resupplying the service or paying the cost of resupply. Nothing in these terms excludes rights under the Australian Consumer Law.

12. Privacy

How we handle personal information is set out in our Privacy Policy, which forms part of these terms.

13. Changes to these terms

We may update these terms. We will post the new version here and update the date at the top. If a change is significant, we will tell you in the app or by email. Continuing to use Mates Picks after a change means you accept it.

14. Governing law

These terms are governed by the laws of Western Australia, Australia, and the courts of that state have jurisdiction.
